License Renewal Confusion

November 2, 2017 by LORIE A BROWN, R.N., M.N., J.D. Leave a Comment

Every 2 years in Indiana, R.N.’s renew their licenses.  Even though the license renewal is due on October 31st of the odd-numbered years, nurses can to begin to renew as early as July of that year.  However, many nurses seem to wait until the last minute to undertake the task. If a nurse renews their license and answers “yes” to any of 6 questions (which I am paraphrasing here): Have you had any charges filed in any State against your license; Have you been denied a license; Other … [Read more...]

Do You Have to Disclose a Criminal Conviction to the Nursing Board?

October 19, 2017 by LORIE A BROWN, R.N., M.N., J.D. 1 Comment

In 2015, a law was passed in Indiana requiring health care providers to disclose criminal convictions within 90 days. Do You Know Your State’s Scope Of Practice?

September 14, 2017 by LORIE A BROWN, R.N., M.N., J.D. 1 Comment

A question I receive often is whether a certain task falls within the scope of practice. Unfortunately, there is no blanket answer. Scope of practice varies state-by-state and institution to institution. Just because you are educated and even trained to perform a certain skill, that does not mean using that skill necessarily falls within your scope of practice. If you do not know or are just not sure, and even if you are sure, double-check! If you perform an activity that is outside your … [Read more...]

Can The Nursing Board Take Away My License?

August 24, 2017 by LORIE A BROWN, R.N., M.N., J.D. 2 Comments

One of the questions I am most frequently asked by nurses is whether the Board of Nursing can take away their nursing license. Unfortunately, the answer to that question is “Yes.”  The license can be taken away temporarily or permanently. The temporary process is called “emergency suspension”.  Unlike in a civil court where there are rules in place to prevent evidence that may not be accurate or trustworthy from coming in, administrative law allows the admission of hearsay, an out of court … [Read more...]
